II. For what purpose and with what legal basis do we process your data?

EXCOM GROUP will process your personal data in accordance with the purposes detailed below:

  • Management of the contractual relationship due to the purchase of products and services

The personal data provided will be processed to manage the purchase of EXCOM GROUP products and services, provide the service, maintain it and manage the contractual relationship with the customer or user.

Category of personal data processed: given name, surnames, email address, telephone number, transactional information deriving from the purchase of products, proof of payment and payment details and/or bank accounts for direct debiting of bills, line portability movements, as well as any type of information collected, as appropriate, through customer service channels, date of birth, tax identification number, postal address, installation address, land line and mobile phone numbers and billing address.

Legal basis:  the legal basis for the processing of your personal data is the performance of the contract signed by and between you and the party responsible for the purchase (contract terms and conditions and the legal bases of the private sale). The contract cannot be formalized without said personal data.

  • Customer service

If you request information on products and send us queries, suggestions, complaints, claims or incidents through any of the EXCOM GROUP channels made available for such purposes (a specific form, telephone number or email address), the personal data will be processed to manage and process your request by email or phone based on the method used by you to send us your request.

Category of personal data processed: given name, surnames, email address, telephone number, transactional information deriving from the purchase of products, proof of payment and payment details, date of birth, and any other information you voluntarily provide with your request.

Legal basis:  the legal basis for the processing of your personal data is the performance of the contract signed by and between you and the party responsible for the purchase (contract terms and conditions and the legal bases of the private sale). The request cannot be processed without the personal data indicated.

  • Sales actions

If you consent, we will process your personal data to manage sales actions, including sending commercial communications on products, services and special offers related to the telecommunications sector to which EXCOM GROUP belongs, including in a personalized manner and with prior profiling through any means including electronic means which may include newsletters, discounts, special offers, relevant information or commercial information on their activities, events, products and sector-related services.

Category of personal data processed:  email address, telephone number and postal address will be processed to send commercial communications. Personalization parameters (demographic criteria, transactional information and socioeconomic parameters inferred) will be processed so that you only receive communications with commercial information we believe best matches your interests.
 

Legal basis: this processing will only be carried out if you voluntarily grant your express consent by ticking the box provided for such purpose on any of the different forms on this website. You are hereby reminded that, in addition to all other rights granted to you by data protection regulations, at any time you may withdraw your consent and ask to be removed from the commercial communications mailing list, ask not to be subject of automated individual decision-making, including the creation of your profile, request human intervention in automated individual decision-making, express your opinion, get answers to any questions to this end or challenge decisions in accordance with the provisions of the section entitled “What are your rights when you provide us with personal data?” included in this Privacy Policy.

  • Sending surveys

If you purchase any of our products or services, EXCOM GROUP may send you surveys using electronic means (email, SMS, telephone calls) aimed at understanding your level of satisfaction, your experience and possible suggestions with regard to the product or service contracted. Your opinion will help improve the EXCOM GROUP processes, products and services.

Category of personal data processed: email, telephone number, transactional information related to the purchase or reservation of products and services, country (in order to guarantee the survey is sent in the language of the country you provided during the purchase process to ensure at all times adequate understanding thereof) and any other non-personal information you provide through the surveys you complete.

Legal basis:  this processing is necessary in order to satisfy the legitimate interests pursued by EXCOM GROUP in understanding its customers’ opinions with regard to the products and services contracted and possible suggestions to such end. It is the understanding of EXCOM GROUP that such does not undermine its customers’ rights and liberties and that there is  balance between the interests of both parties as such processing makes it possible to achieve the purpose pursued (understanding customers’ opinions), which is necessary for EXCOM GROUP to be able to improve its products, services and operational processes and customers can get enhanced quality out of their experiences. Additionally, as a result of the volume of customers accessing EXCOM GROUP services, it is our understanding that sending surveys via electronic means is necessary for the purpose described and that there is no other mechanism that enables the achievement of such purpose with the same efficacy.  Likewise, it is our understanding that our customers may have reasonable expectations with regard to the handling of this processing based on the contractual relationship they maintain with EXCOM GROUP due to the purchase or reservation of products and services, on the specific information provided by EXCOM GROUP during the contracting process and on the fact that this type of processing is done as part of standard and habitual industry practices for service provision companies. Moreover, in order to achieve this purpose, you are hereby reminded that only non-sensitive and strictly necessary personal data will be processed, that no surveys are sent to minors under the age of fourteen (14) and that we only send them occasionally and for a limited period of time to our customers.

Nonetheless, you may object at any time to the processing of your personal data or exercise all other rights granted by data protection regulations in accordance with the procedure described in the section entitled “What are your rights when you provide us with personal data?” included in this Privacy Policy.

  • Market research and analysis

EXCOM GROUP will separate the postcode and the country provided by you through forms on this website from the rest of the personal information in order to compile quantitative and qualitative aggregate statistical reports for market analyses and studies allowing us to evaluate our market positioning based on the geographic area from where products and services are purchased and make strategic business decisions (i.e., sales trends).

Category of personal data processed: aggregate information relating to postcodes and countries, previously separated form the rest of the personal data provided.

Legal basis: this processing is necessary in order to satisfy the legitimate interests pursued by EXCOM GROUP in knowing and understanding the geographic area from where its products and services are purchased in order to achieve the aim described. It is the understanding of EXCOM GROUP that such does not undermine its customers’ rights and liberties and that there is  balance between the interests of both parties (customers and EXCOM GROUP) as such processing makes it possible to achieve the purpose pursued (evaluating our market positioning), which is necessary for EXCOM GROUP to be able to make strategic business decisions and even improve its products, services and operational processes, which would provide our customers with enhanced quality in their experiences.  Additionally, we believe there is no other more moderate mechanism that allows us to achieve this aim with the same efficacy as only non-sensitive basic information (postcode and country) are used after being previously separated from any personal data that could individually identify customers when pursuing such purpose. Likewise, it is our understanding that our customers may have reasonable expectations with regard to the handling of this processing based on the contractual relationship they maintain with EXCOM GROUP due to the purchase or reservation of products and services, on the specific information provided by EXCOM GROUP and on the fact that this type of processing is done as part of standard and habitual industry practices for service provision companies.

  • Dissemination of the content users create mentioning or tagging EXCOM GROUP in social media

If you share content through social media and mention the EXCOM GROUP user account (i.e., you mention us in stories or in posts...), we may process your personal data to promote the EXCOM GROUP image on its social media profiles by sharing such publication where you mention EXCOM GROUP.

You are hereby informed that we do not control the processing of personal data of users of social media where EXCOM GROUP has a registered account (Facebook, Instagram and LinkedIn). For more information on how and for what purposes the social media provider compiles and processes personal data, and users’ rights and options as concerns protecting their privacy, refer to the applicable social media provider’s privacy policies.

Category of personal data processed: user account, image and/or voice of the social media user and/or any third parties who may appear in their publication.

Legal basis: this processing will only be carried out if you voluntarily grant your express consent by responding affirmatively to the direct message sent from the EXCOM GROUP social media profile. You are hereby reminded that, in addition to all other rights granted to you by data protection regulations, at any time you may also withdraw your consent so that we delete the publication, either in accordance with the provisions of the section entitled “What are your rights when you provide us with personal data?” included in this Privacy Policy or through a direct message sent to our social media profile where we shared such content.

  • Prevention and detection of possible fraudulent activities

Activate the necessary mechanisms to prevent and detect improper use of the website or potential fraud associated with the purchase or reservation of products and services that may affect EXCOM GROUP or its customers. If any possible fraudulent activities associated with the payment of products and services are detected, EXCOM GROUP may communicate the information on the transaction affected and the identification details of the person engaging in it to the owner of the platform used for payment and, where appropriate, to the competent public authorities so the pertinent measures may be taken in each case.
 

Category of personal data processed: transactional information, payment information and contact details provided during possible fraudulent purchase processes.
 

Legal basis:  this processing is necessary in order to satisfy the legitimate interests pursued by EXCOM GROUP. It is the understanding of EXCOM GROUP that such does not undermine any individual’s rights and liberties and that there is  balance of legitimate interests to the extent that such processing makes it possible to achieve the aim pursued (prevent and detect possible fraudulent activities) and is beneficial to customers and website users, as it enables us to take the necessary measures to protect them from unlawful activities such as attempted fraud by third parties, to EXCOM GROUP in preventing improper use of the website and its products and services and to society at large as it guarantees discouraging the commission of fraudulent activities and detects them when they occur.
 

  • Use of cookies and similar technologies

EXCOM GROUP uses first-party and third-party cookies and similar technologies on this website and, as a result, they process, save and share users’ information and personal data when they browse it, in accordance with certain purposes and the configuration parameters made available at all times to users.

  • Compliance with legal obligations

Personal data will be processed in order to comply with legal obligations applicable to the Data Controller as a result of the relationship maintained with you as a customer and the processing of your personal data in accordance with European Union Law and/or the applicable internal legal system (legal obligations required by tax regulations, personal data protection regulations, trade law regulations, user and consumer protection regulations, information society and e-commerce services regulations, civil law regulations, accounting standards, etc.).

Categories of personal data processed:   given name, surnames, phone number, email address, document proving the data subject’s identity, transactional information on their purchase, where applicable, or any other information that may be part of compliance with legal obligations at the petition or request of the competent supervisory authorities.

Legal basis: compliance with legal obligations applicable to the Data Controller pursuant to European Union Law and/or the applicable internal legal system. Without your personal data, the Data Controller would not be able to adequately comply with the legal obligations indicated or fulfil any possible legal responsibilities deriving from the relationship maintained with you or the processing of your personal data.
 

  • Video surveillance

Control of entrance inside our shops and headquarters for prevention and customer orientation and compliance with internal policies, verification of the conditions and functioning of the general facilities in shops and at headquarters, the development of surveillance and people and asset protection services when services are contracted with security companies, as well as the verification of alarms through cameras installed in shops or at headquarters (alarm management services) for their transfer and disclosure to the police or competent judicial authorities. As concerns employment relationships and following compliance with informational obligations, control the regularity of compliance by employees of their employment obligations, monitor for any serious offences by employees at the workplace, detect abusive use of work tools, organizational requirements and workplace safety with personal fines.

Category of personal data processed: The personal data EXCOM GROUP handles as a result of the use of video surveillance systems at its facilities; particularly, the images captured by these systems.

Legal basis: The legal basis of this processing is mainly public interest as we try to guarantee the safety of people, assets and facilities through the video surveillance system. Nonetheless, the legal basis may also be the legitimate interest of the data controller.

III. What criteria do we use to determine personal data storage periods?

Depending on the purpose for which we process your personal data, the applicable storage criteria are listed below:

  • Management of the contractual relationship due to the purchase or reservation of products and services:  as long as the contractual relationship with your is maintained due to the purchase or reservation of products and services.
  • Customer service: for the time necessary to manage and process your request, complaint, incident or claim.
  • Commercial actions: we will process your data until you ask for removal from the mailing list or your contract with EXCOM GROUP is terminated.
  • Mailing of surveys: the personal data provided will be saved for a maximum of 12 months unless you request the deletion of your personal data or object to such processing before the end of this period, in which case your personal data will no longer be processed for this purpose.
  • Market research and analysis: the information processed for this purpose is separated and cannot be linked to any of your other personal information. Nonetheless, if you ask for your data to be deleted or object to processing prior to this separation, the data will no longer be processed for this purpose.
  • Prevention and detection of possible fraudulent activities: until any possible fraudulent actions that may be detected are resolved after which they will be blocked until any legal liability for EXCOM GROUP as a result expires.
  • Use of cookies and similar technologies: the information will be processed as long as the consent granted by users for the installation of cookies on their device remains valid. If the user does not delete such consent using the mechanisms offered in our (link to the Cookies Policy), the information will be saved for the period the cookies or similar technologies installed on their device are valid.
  • Compliance with legal obligations: the personal data will be blocked as long as EXCOM GROUP may be held liable for compliance with its legal obligations.
  • Video surveillance:  the images captured by video surveillance systems will be saved for a period of thirty (30) days. If necessary, the images may be saved blocked for a longer period in order to comply with legal obligations and/or defend the parties’ interests (i.e., if they need to be used as proof in any proceedings or claim procedure).

In any of the foregoing situations, when personal data are not longer pertinent to the purposes for which they were collected or, where applicable, you withdraw consent or exercise your right of deletion or objection to the processing indicated, the Data Controller, as applicable, may save them duly blocked (identification and reservation of the personal data, taking the appropriate technical and organizational measures to prevent the processing thereof, including viewing) in case they may need to be disclosed to the competent public administrations and, in particular, the competent data protection supervisory authority, judges, courts or the public prosecutor’s office for the period of time during which legal actions deriving from the relationship maintained with your or the processing of your personal data may be taken and/or the storage periods legally provided for in accordance with European Union Law and/or the internal legal system. Following the expiry of said period, your personal data will be physically eliminated without any possibility of recovery.

IV. Who do we communicate your data to?

Only if necessary to comply with legal responsibilities or storage deadlines, your personal data may be disclosed to the competent public authorities and, in particular, the competent data protection supervisory authority, judges or the public prosecutor’s office pursuant to European Union Law and/or the internal legal system.

In general, your personal data will remain with EXCOM GROUP to the extent possible. However, EXCOM GROUP may transfer them to one or more subsidiaries in specific cases. In particular, such transfers may occur in the situations described below:

-When you have granted your explicit prior consent to share your data with other EXCOM GROUP companies for commercial and advertising purposes within the telecommunications field.

Likewise, if you have consented, EXCOM GROUP will transfer your data to other EXCOM GROUP companies to synchronize and update contact details so EXCOM GROUP and these entities may process your synchronized data for the intended purposes.

In addition, EXCOM GROUP has providers who may also process your personal data to provide the services associated with the purposes for which you have been informed (including but not limited to companies operating in the following sectors: information security, customer relations management (CRM), technology, legal advising, marketing, customer service, professional multidisciplinary services, IT services, etc.). These providers will only access your personal data to provide services for you in the name and on behalf of EXCOM GROUP, always following its instructions and without being able to use said data for their own purposes and/or unauthorized purposes at any time.

V. Are your data disclosed outside the EU?

If in the scope of the processing operations described in the section entitled “For what purpose do we process your personal data? in this Privacy Policy, your data are processed in countries outside the EU or the European Economic Area (“EEA”) with respect to which there is no adequacy decision by the European Commission, EXCOM GROUP will guarantee your data are processed in accordance with European data protection standards.

To the extent necessary and in order to guarantee the security of data transfers to recipients in countries outside the EU or EEA, we will use international transfer agreements based on Standard Contractual Clauses or other mechanisms that allow the transfer of data subject to data protection regulations, including taking appropriate technical and organizational protection measures for the protection of the data transferred.

Certain countries outside the EU have already been officially declared by the EU as countries with an adequate level of data protection similar to European protection. This means that, pursuant to applicable data protection regulations, any transfer to those countries does not require independent official approval or any separate agreement.

VI. ¿What are your rights when you provide us with personal data?

You may exercise your rights of access, rectification, objection, restriction, portability and, where appropriate, not to be subject of automated individual decision-making, including the creation of profiles, by sending your request in writing to the attention of the DPO at the postal address of Avda. de Bruselas, 16 1º Planta Izq CP 28108 Alcobendas. If there are any reasonable doubts about the data subject’s identity, a copy of an official document (national ID card/foreigner’s ID card/passport) may be requested in order to process the request.

On the other hand, in relation to processing based on obtaining consent, you are hereby informed that you may withdraw it or object to processing at any time using the procedure detailed in the paragraph above. Moreover, you are hereby reminded that, if you have expressly consented to the mailing of communications with commercial information, we also offer the possibility of requesting removal from the mailing list through the means made available for such purpose in each of the commercial communications you may receive.

VII. How did we get your personal data?

The personal data processed by EXCOM GROUP are provided directly by you as the data subject through this website and/or at some time during the relationship maintained with you.

You may file a claim with the Spanish Data Protection Agency in order to safeguard your rights if you wish.
